Documents for buying and selling
In order to pass a title from seller to buyer, the seller must provide a certification of Inteiro Teor from the Registro de Imóveis. This document, valid for 30 days, proves that the seller is the current legal owner of the property. The seller should also provide documentation that he owes nothing for which the court could claim the property as payment. This documentation can be provided by the cartorio in the seller's city of residence.
The town can provide an official cirtification that there are no taxes owed on the property, or a simple print out sumarizing the debts (if there are any) from previous years. Most buyers accept the simple print out of this information from previous years and the current years payment bills and recipts.
SAMAVE provides their own certification that a property has no debts associated with it, or a printed summary of existing debts. These documents can be requested at the SAMAVE office.
